INVITATION TO TENDER AND EXPRESSION OF INTEREST

INTRODUCTION
The Niger Delta Basin Development Authority (NDBDA), a Parastatal of The Federal Ministry of Water Resources in furtherance to its statutory mandate intends to undertake the Procurement of various Works, Goods and Services under the 2021 Appropriation Act and in accordance with Extant Provision of Section 25 of the Public Procurement Act, 2007.

The Authority, therefore, invites interested, experienced, and competent Contractors, Suppliers, and Consultants/Service Providers with relevant experience for consideration for the execution of the following projects.

CATEGORY C-GOODS (ZONAL INTERVENTION PROJECTS)

LOT C PROJECT DESCRIPTION
C1 (ZIP) PROCUREMENT OF NPK FERTILIZER FOR FARMERS IN JEMA’A/SANGA FEDERAL CONSTITUENCY, KADUNA STATE

ELIGIBILITY REQUIREMENTS:
Interested and Competent Contractors, Suppliers and Service Providers/Consultants wishing to carry out any of the Projects under the above three (3) categories are required to submit the following documents:
i. Evidence of Certificate of Incorporation with Corporate Affairs Commission (CAC) including Forms CAC2 and Form CAC7;
ii. Evidence of Company’s Income Tax Clearance Certificate for the last three years (2018, 2019,2020); valid till 31st December 2021;
iii. Evidence of Pension Clearance Certificate valid till 31st December 2021 (where applicable);
iv. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2021 (where applicable);
v. Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December 2021;
vi. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers; by submission of the Interim Registration Report (IRR) Expiring on 31 December, 2021 or valid Certificate issued by BPP;
vii. Sworn Affidavit disclosing whether or not any officer of the relevant Committees of the Niger Delta Basin Development Authority or the Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
viii. Company’s Audited Accounts for the last three (3) years (2018, 2019, 2020);
ix. Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
x. Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional Qualifications such as COREN, QSRBN, ARCON, CORBON etc.;
xi. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Award, Valuation Certificates, Job Completion Certificates and Photographs of the Projects;
xii. List of Plants/Equipment with proof of ownership/lease (where applicable);
xiii. For joint Ventures/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance Certificate, IRR & Sworn Affidavit are compulsory for each JV Partner);
xiv. Services: Evidence of Firm’s current Registration with relevant regulatory professional body(ies);
xv. For Supply of Equipment: Letter of Authorization as representative of the Original Equipment Manufacturers (OEMs);
xvi. All documents for submission must be transmitted with a covering/forwarding letter under the company/firm’s letter headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.) and e-mail address. The Letter headed Papers must bear the Names and Nationalities of the Directors of the Company at the bottoms of the page, duly signed by the authorized officer of the firm.

COLLECTION OF TENDER DOCUMENTS (GOODS & WORKS)
Interested Companies are to collect the Standard Bidding Document (SBD) from the Office of the Head of Procurement, Block F, Niger Delta Basin Development Authority, 21 Azikiwe Road, P.M.B. 5676, Port Harcourt, on evidence of payment of a non-refundable fee of N10,000.00 (Ten Thousand Naira) only, per Lot, paid into the Treasury Single Account of the Niger Delta Basin Development Authority (Niger Delta RBDA-025204400100) Remita account in any reputable commercial bank in Nigeria.

SUBMISSION OF TENDER DOCUMENTS

Category A-Invitation to Tender (Works)
Prospective bidders are to submit bid for each of the lot desired, two (2) hard copies each of the technical and financial bids with softcopy of financial bid only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “Technical Bid” or “Financial Bid”. Thereafter put the two sealed envelopes together in a bigger sealed envelope addressed to the Managing Director, Niger Delta Basin Development Authority, 21 Azikiwe Road, P.M.B. 5676, Port Harcourt, Rivers State and clearly marked with the Name of the Project and the Lot Number.

Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at Office of the Head of Procurement, Block F, Niger Delta Basin Development Authority, 21 Azikiwe Road, P.M.B, 5676, Port Harcourt, not later than 12.00 noon, Monday 21st June, 2021.

Category B-Expression of Interest (EoI) Consultancy Services
Interested Firms are to submit two (2) bound copies of Expression of Interest (EoI) documents, separated by dividers. The documents should be submitted in a sealed envelope and addressed to the Managing Director, Niger Delta Basin Development Authority, 21 Azikiwe Road, P.M.B. 5676, Port Harcourt, Rivers State and clearly marked with the Name of the project and the Lot Number. Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and should be deposited in the Tender Box at the address above, not later than 12.00 noon on Monday 21st June, 2021.

OPENING OF BIDS DOCUMENTS
Category A-Invitation to Tender (Works and Goods)
Technical Bids will be opened immediately after the deadline for the submission at 12.00 noon Monday 21st June, 2021 at the Authority’s Conference Hall, while the Financial Bids will be kept un-opened. Please ensure that you sign the Bid Submission Register at the address stated above, as the Authority will not be held liable for misplaced or wrongly submitted bids.

Category B-Expression of Interest (EoI)
Expression of Interest (EoI) documents will be opened immediately after the deadline for submission at 12.00 noon on Monday 21st June, 2021 at the Authority’s Conference Hall. Please ensure that you sign the Bid Submission Register at the address stated above, as the Authority will not be held liable for misplaced or wrongly submitted bids.

GENERAL INFORMATION
i. Bids must be in English Language and signed by an official authorized by the bidder;
ii. Late submission will be returned un-opened;
iii. Bidders should not bid for more than three (3) Lots;
iv. All costs will be borne by the bidders as the Authority will not be held responsible for any cost or expenses incurred by any interested party (ies) in connection with any response to this invitation;
v. Non-Compliance with the conditions stated herein will lead to automatic disqualification of the bidder from the bidding process;
vi. Presence of bidders/representatives and members of the public shall not be required during the bid opening ceremony in compliance with COVID-19 Guidelines. The Bids Opening will be covered by video recording with the presence of two (2) representatives of private sector professional bodies and Civil Society Organization in the areas of Anti-Corruption/Transparency;
vii. Bid documents can also be collected in soft copies and Bidders can submit through Post (Courier Services);
viii. Goods & Works: Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned un-opened;
ix. Services: Only shortlisted firms will be invited at a later date for collection of Request for Proposals (RfPs);
x. The Niger Delta Basin Development Authority is not bound to Pre-qualify any bidder and reserves the right to annul the Procurement Process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
