EXPRESSION OF INTEREST (EOI)/REQUEST FOR INVITATION TO TENDER (TECHNICAL AND FINANCIAL) FOR THE EXECUTION OF 2025 CAPITAL PROJECTS.
1.0 INTRODUCTION
1.1 Nigerian Electricity Management Services Agency (NEMSA) wishes to undertake the procurement of Goods, Works and Services under the 2025 Capital Appropriation. In compliance with the Public Procurement Act 2007, the Agency hereby invites experienced and reputable Suppliers/Contractors to tender for the procurement and execution of the under listed projects.
SCOPE OF THE PROCUREMENT:
2.0 ELIGIBILITY REQUIREMENTS-
Prospective bidders should submit the following documents:
a. Evidence of Certificate of Incorporation Issued by the Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7;
b. Evidence of Company’s Income Tax Clearance Certificate for the last three (3) years valid till 31st December, 2025; with minimum average annual turnover of N20 million;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2025 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2025 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2025;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2025 or valid Certificate issued by BPP.
g. Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Nigerian Electricity Management Services Agency or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
h. Company’s Audited Accounts for the last three (3) years – 2022, 2023 & 2024;
i. Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional Certificates such as COREN, QSRBN, ARCON, CORBON, SURCON, etc.;
k. Verifiable documentary evidence of at least three (3) similar jobs (in size, nature & complexity) executed In the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
l. Works: List of Plants/Equipment with proof of Ownership/Lease Agreement;
m. All companies bidding should include where applicable the description of current Health, Safety, and Environment (HSE) procedures, plan, manuals and HSE performance statistic over the last three (3) year e.g. accidents, fatalities;
n. All companies bidding for Category B must have verifiable evidence of a valid NEMSA Certificate;
o. All companies bidding for Category A MUST have Letter of authorization from Original Equipment Manufacturer OEM from Europe for compatibility with the existing Meter Test Benches;
p. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided indicating among others the Lead Partner (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner).
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.
4.0 COLLECTION OF TENDER DOCUMENTS
Interested Companies are to collect the Standard Bidding Document (SBD) from the Procurement Department during working hours on presentation of evidence of payment of a non-refundable tender fee of N10,000.00 (Ten Thousand Naira only) per Lot, paid into the Nigerian Electricity Management Services Agency’s (NEMSA) Remita Account in any reputable Commercial Bank in Nigeria.
5.0 SUBMISSION OF TENDER DOCUMENTS
Prospective bidders are to submit completed bid document (Technical & Financial) for each lot desired, one (1) original and two (2) copies each of the Technical & Financial bids with soft copy (in flash drive) of the financial bid only in MS Excel format, packaged separately in sealed envelopes labeled “Technical Bid” and “Financial Bid” with the appropriate Project Title and Lot No. Thereafter, put the two sealed envelopes together in a bigger envelope clearly addressed to the MD/CEO & CEIF as shown below with the appropriate Project Title and Lot No. at the top right-hand corner. The reverse side of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at the Office of the Head Procurement, NEMSA CHQ, No. 4, Dar es Salaam Crescent, Wuse II, Abuja not later than 12:00Noon, Monday, 27th October 2025.

6.0 OPENING OF TECHNICAL/EOI BIDS
The Opening of the technical/EOI bids only will commence immediately after the deadline for the bid submission at 12:00Noon, Monday, 27th October 2025 at the Procurement Department, NEMSA in the presence of bidders or their representatives. Only the technically successful bidders will be invited for the opening of their financial bids at a later date while the financial bids of the unsuccessful bidders will be returned unopened.
7.0 PLEASE NOTE:
I. All bids (technical & financial) must be prepared in English Language and signed by an official authorized by the bidder;
II. Every document submitted shall be subject to verification;
III. Bidders shall not bid for more than one (1) lot, if discovered, the bidder(s) will be disqualified;
IV. Bidding documents should contain a table of contents and must be properly paginated and items required above to be arranged in the order of sequence as listed;
V. Bids submitted after the deadline for submission would be returned unopened.
8.0 DISCLAIMER NOTICE:
I. This Advertisement shall not be construed as a commitment on the part of NEMSA to award any or all the above contracts, nor shall it entitle any Contractor/Consultant submitting documents to claim any indemnity from NEMSA.
II. Submissions through email or fax will not be accepted.
III. The Agency shall not be responsible for any costs or expenses incurred by any Contractor/Consultant in connection with the preparation of their documents.
IV. The Nigerian Electricity Management Services Agency is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
