INVITATION TO TENDER/EXPRESSION OF INTEREST (EOI)

INTRODUCTION
1.0 Brief Background
The Investments and Securities Tribunal (IST) the adjudicatory arm of the Nigeria Capital Market established under Part XVII, Section 314 of the Investments and Securities Act (ISA) 2025. In compliance with the Public Procurement Act (PPA), 2007, the Tribunal hereby invites experienced and competent contractors, suppliers, service providers, firms/companies with relevant experience and proven records of accomplishment for the underlisted project and expression of interest.

1.1 SCOPE OF WORK/SUPPLY

2.0 PREQUALIFICATION/GENERAL ELIGIBILITY REQUIREMENTS
a. Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7. Business Name is also acceptable;
b. Evidence of Company’s income Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all the Partners in case of Business Name) for the last three (3) years (2023, 2024, 2025) valid till 31st December, 2026;
c. Evidence of current Pension Clearance Certificate valid till 31st December, 2026 (This requirement is only applicable to bidders whose number of staff is 15 and above and in line with the PENCOM ACT. However, bidders with less than fifteen (15) staff are to provide a sworn affidavit to that effect);
d. Evidence of current Industrial Training Fund [ITF] Clearance valid till 31st December, 2026 (This requirement is only applicable to bidders whose number of staff is five (5) and above or the bidder’s Annual Turnover is N50 million and above. However, bidders with less than five (5) staff or the bidder’s Annual Turnover less than N50m are to provide a sworn affidavit to that effect);
e. Evidence of current Nigeria Social Insurance Trust Fund [NSITF] Clearance Valid till 31st December, 2026;
f. Evidence of Registration on the National database of Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2026 or valid Certificate issued by BPP;
g. Detailed Company’s Profile with Curriculum Vitae of Key Staff to be deployed for the project, including copies of their relevant academic/professional qualifications such as EHCON, etc.;
h. Evidence of Letter of Authorization as representative of the Original Equipment Manufacturers (OEMs) in case of the Supply of Generating Set;
i. A recently Sworn Affidavit disclosing (date not earlier than the date of this advertisement and addressed to the Investments and Securities Tribunal (IST):
i. Whether or not any officer of the relevant committees of the Investments and Securities Tribunal or Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
ii. That the company is not in receivership, insolvency or bankruptcy; and
iii. That the company does not have any Director who has been convicted by any court of law in Nigeria and any other country for criminal offences in relation to fraud or financial impropriety.
j. Company’s Audited Accounts for the three (3) years – 2023, 2024, 2025 Stamped/Sealed by Chartered Accountant and duly acknowledged by the Nigeria Revenue Services (NRS);
k. Evidence of financial capability to execute the project by submission of Reference Letter from a reputable commercial bank in Nigeria, addressed to the IST indicating willingness to provide credit facility for the execution of the project when needed;
l. Verifiable documentary evidence of manufactured and marketed specific goods for at least two (2) years, and similar for at least five (5) years, and including Letters of Awards, Valuation Certificates, Job Completion Certificates and photographs of supply;
m. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Job Completion Certificates and photographs of projects;
n. List of Plants/Equipment with proof of Ownership/Lease to be deployed for the Sanitary Activities/Maintenance of Dumpsites and Cleaning projects;
o. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, NSITF Compliance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner);
p. All documents for submission must be transmitted with Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Numbers (preferably GSN No.) and e-mail address. The Letterhead paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page duly signed by the authorized officer of the firm.

3.0 SPECIFIC ADDITIONAL REQUIREMENTS FOR PREQUALIFICATION
a. Bidders for the provision of Cleaning Services must be registered with Environmental Health Council of Nigeria (EHCON) in category ‘A’ and shall provide evidence of valid practicing license expiring 31st December 2026 and shall have a Minimum Average Annual Turnover of N150,000,000.00 for three (3) years;
b. Bidders for the provision of Security Services must be registered with the Nigeria Security and Civil Defense Corps (NSCDC) and shall have a Minimum Average Annual Turnover of N200,000,000.00 for three (3) years;
c. Bidders for the provision of Cleaning and Security Services must have an operational office in Abuja;

4.0 COLLECTION OF TENDER DOCUMENTS
Interested companies are to collect the Standard Bidding Documents (SBDs) from the office of the Director, Procurement 2nd floor, right wing, Procurement Department, Plot 1072 Cadastral Zone B10, Along Jabi-Airport Road, Opposite Major Oil Filling Station, Dakibiyu Jabi, Abuja with evidence of payment of a non-refundable tender fee of N 10,000.00(Ten thousand naira)only per lot, paid into the Investments and Securities Tribunal’s Remita account (3000045568) via generation of RRR on the Remita Platform in any reputable commercial bank in Nigeria.

5.0 SUBMISSION OF TENDER DOCUMENTS
Prospective bidders are to submit bid for each of the Lot desired, two (2) bound copies each of the Technical and Expression of Interest (EoI) documents separated by dividers and arranged appropriately and financial bids with softcopy of financial bids only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “Technical Bid” or “Financial Bid” or “Expression of Interest” as the case may be. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to the Honourable Chairman, Investments & Securities Tribunal, Plot 1072 Cadastral Zone B10, Major Oil Filling Station, Daki-biyu, Jabi, Abuja and clearly marked with (the name of the project and the Lot number). Furthermore, the reverse end of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at 2nd floor, Procurement Department Plot 1072 Cadastral Zone B10, Along Jabi-Airport Road, Opposite Major Oil Filling Station, Dakibiyu, Jabi, Abuja not earlier than Monday 15th June, 2026.

Note that it is mandatory to fill in the relevant Tendering Forms attached to the Standard Bidding Document, as non-filling for these documents will attract outright disqualification.

6.0 OPENING OF BIDS
Only the Technical bids and Expression of Interest (EoI) shall be opened immediately after the deadline for submission on Monday 29th June, 2026 by 12.00 noon in the Tribunal’s Court Room, Ground Floor right wing, Plot 1072 Cadastral Zone B10, Along Jabi- Airport Road, Opposite Major Oil Filling Station, Dakibiyu Jabi, Abuja, while the Financial bids will kept un-opened.
Please ensure that you sign the Bid Submission Register in the office of the Director, Procurement 2nd floor, right wing, Procurement Department, Plot 1072 Cadastral Zone B10, Along Jabi- Airport Road, Opposite Major Oil Filling Station, Dakibiyu Jabi, Abuja, as the Investments & Securities Tribunal will not be held liable for misplaced or wrongly submitted bids.

7.0 GENERAL INFORMATION
a. Bids/ EoI must be in English Language and signed by an official authorized by the bidder;
b. Bids/EoI submitted after the deadline for submission would be returned un-opened;
c. All costs will be borne by the bidders;
d. All prices shall be quoted in Naira;
e. All CAC, PENCOM, ITF, NSITF and Tax Clearance Certificates may be referred to Security Agencies, Corporate Affairs Commission (CAC), Nigeria Revenue Services (NRS), Industrial Training Fund (ITF), National Pension Commission (PENCOM), Nigeria Social Insurance Trust Fund (NSITF) and any other relevant bodies for verification.
f. This advertisement shall not be construed to be a commitment on the part of the Investments & Securities Tribunal to award any form of contract to any respondent or entitle any firm submitting documents to claim any indemnity from the Tribunal;
g. Only pre-qualified bidders/ shortlisted firms at technical evaluation will be invited at a later date for financial bids opening and for collection of Request for Proposals, while the financial bids of un-successful bidders will be returned un-opened.
h. The Investments & Securities Tribunal is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
