INVITATION TO TENDER FOR WORKS AND SERVICES FOR FY2024 CAPITAL PROJECTS (PHASE III)

1. INTRODUCTION
1.1 The Benin-Owena River Basin Development Authority (BORBDA), hereinafter referred to as “the authority”, a parastatal of the Federal Ministry of Water Resources and Sanitation, is desirous of executing her FY2024 capital projects. In compliance with the Public Procurement Act, 2007, the authority hereby invites interested, experienced and competent contractors to submit bids for the implementation of the following projects:

2. SCOPE OF WORKS/GOODS/SERVICES
The scope of works/goods/services are categorized and packaged into lots as shown in the table below:

3. ELIGIBILITY REQUIREMENTS
a. Evidence of certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including form CAC1.1 or CAC2 and CAC7. Business name with form BN1 is also acceptable for services;
b. Evidence of Company’s Income Tax Clearance Certificate(or personal income tax clearance certificates of al partners in case of business name) for the Last three (3) years (2021, 2022, &2023) valid till 31st December, 2024;
c. Evidence of pension Clearance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate Valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is ₦50Million and above);
e. Evidence of Nigerian social Insurance Trust Fund (NSITF) Clearance Certificate Valid till 31st December 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn Affidavit:
 Disclosing whether or not any officer of the relevant committees of the benin-owena river basin development authority or Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;

h. Company’s Audited Accounts for the last three (3) years -2021,2022,2023;
i. Reference letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s profile with the Curriculum Vitae of key Staff to be deployed for the project, including copies of their Academic/ Professional certificates such as COREN, QSRBN, ARCON, CORBON, NGSA etc.;
k. Verifiable documentary evidence of at least three (3) similar jobs (in size, nature and complexity), executed in the last five (5) years including Letters of awards, Valuation Certificates, Job Completion Certificates and photographs of the project;
l. For lot B41 & B42: List of Plants/Equipment with proof of Ownership/Lease Agreement;
m. For lot C3: letter of authorization as representative of the original equipment manufacturers (OEMs);
n. For lot D14 & D15: evidence of firm’s current registration issued by the Nigerian geological survey agency (NGSA), or other related regulatory professional body(ies);
o. For lot E3: evidence of firm’s current license issued by the Nigerian security and civil defence corps (NSCDC);
p. For joint Venture/ Partnership, Memorandum of Understanding (MoU) indicating lead Partner should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM NO.) and e-mail address. The Letter head Paper must bear the names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

4. COLLECTION OF TENDER DOCUMENTS (CATEGORIES B,C & E)
Interested companies are to collect the standard bidding document (SBD) from the office of head of procurement unit, room 067, ground floor, benin-owena river basin development authority, KM 24, benin/sapele road, obayantor on presentation of evidence of payment of a non-refundable tender fee of N10, 000.00 per lot, paid into the benin-owena river basin development authority’s remita account in any reputable commercial bank in Nigeria. Bidders are to generate remita retrieval reference (RRR) and pay into the BORBDA remita e-collection IGR account number 025203800100. The GIFMIS code for the tender fees is 1000020623.

5. SUBMISSION OF TECHNICAL BIDS AND EXPRESSION OF INTEREST
5.1 For expression of interest (EoI), interested firms should submit two (2) bound copies expression of interest (EOI) documents duly signed, paginated, separated by dividers and arranged in the order outlined in 3.0 above. The reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated tender box not later than 12:00 noon, Monday, 23rd December, 2024
5.2 prospective bidders for invitation to tender, are to submit two (20 hard copies each for the technical and financial bids with softcopy of the financial bid only in MS-0excel format; packaged separately in sealed envelopes and marked as “technical bid” or “financial bid”, thereafter, put the two sealed envelopes together in a bigger envelope and clearly marked with the name of the project and the lot number at the top right corner. Furthermore, the reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated tender box not later than 12:00 noon, Monday, 6th January, 2025.
5.3 Each sealed envelope of applicants should be addressed to:

5.4 Inclusion of a bid security of 2% of the bid price for works of three hundred million naira (N300m) and above; and for goods of one hundred million naira (N100m) and above.

6.0 OPENING OF TECHNICAL BIDS AND EXPRESSION OF INTEREST
The EOIs and technical bids will be opened immediately after the deadlines for submission at 12:00 noon, Monday, 23rd December, 2024, and 12:00 noon, Monday, 6th January, 2025, respectively in the new conference room, benin-owena river basin development authority, km 24, benin/sapele road, obayantor, while the fincial bids will be kept unopened. Bidders should please ensure that they sign the EOI/bid submission register in the office of the head, procurement unit, ground floor, room 067, BORBDA headquarters complex, km 24, benin/sapele road, obayantor, as the benin-owena river basin development authority will not be held liable for misplaced or wrongly submitted bids. 7.0 GENERAL INFORMATION
a. EOIs/bids must be in English language and signed by an official authorized by the bidder;
b. The authorized official shall be introduced to the authority by a letter of authority duly signed by the director or secretary of the company;
c. EOIs/bids submitted after the deadline for submission would be returned un-opened;
d. A successful bidder will not be awarded for more than one (1) lot;
e. All costs will be borne by the bidders;
f. Lot B41, B42, C3 & E3: only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of unsuccessful bidders will be returned unopened;
g. Lot D14 & D15: only shortlisted applicants at EOI’s evaluation will be invited at a later date for collection of request for proposal;
h. The EOIs/technical bids will be opened in the presence of bidders or their representatives, CSOs in the areas of anti-corruption and transparency and private professional bodies;
i. Bid documents can also be collected in soft copies and bidders can submit through post (courier services) bids submitted through post must be received before the deadline for submission of bids, otherwise the bid will be returned unopened;
j. The Benin-Owena River Basin Development Authority is not bound to pre-qualify/shortlist any applicant and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with section 28 of the Public Procurement Act, 2007.
