INVITATION TO TENDER/EXPRESSION OF INTEREST
1. PREAMBLE
The Border Communities Development Agency (BCDA) is a Federal Government interventionist Agency established by an act of Parliament to develop all Border Communities’ amenities through the implementation of planned and sustainable projects. Therefore, in compliance with the requirements of the Public Procurement Act 2007 and Extant Regulations of Federal Government on procurement of Goods, Works and Services, BCDA wishes to invite experienced and competent Contractors/Suppliers to submit bids for the under listed 2024 capital projects which were initially omitted from the first advertorial placed in 15th April, 2024.

3. ELIGIBILITY REQUIREMENTS:
a. Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including Form CAC 1.1 or CAC2 and CAC7. Business Name is also acceptable for Services;
b. Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all the partners in case of Business Name) for the last three (3) years valid till 31 December, 2024;
c. Evidence of Pension Clearance Certificate valid till 31 December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31″ December 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn affidavit
• Disclosing whether or not any officer of the relevant committees of Border Communities Development Agency or the Bureau of Public Procurement is a former or present Director, stakeholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• That the company is NOT in receivership or subject to any form of insolvency or bankruptcy or winding up petition or proceedings;
• That no Director of the company has ever been convicted in any country of any criminal offense bordering on fraud or financial impropriety;
• That the company does not have existing loan or financial liability with a bank, other financial institutions of third party that is classified as doubtful, non-performance, bad or whose repayment portion has been outstanding for the last four (4) months.
h. Company’s Audited Accounts for the last three years (2021, 2022 & 2023);
i. Reference letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s profile with the curriculum Vitae of key staff to be deployed for the project, including copies of their academic/professional qualifications such as COREN, QSRBN, ARCON, CORBON etc;
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
l. Works: List of Plants/Equipment with proof of Ownership/Lease agreement;
m. For supply of Equipment: Letter of Authorization as representative of the Original Equipment Manufacturer (OEMs)
n. Electricity jobs: Evidence of current licence issued by Nigerian Electricity Management Services Agency (NEMSA)
o. Consultancy service: evidence of firm’s current registration with relevant regulatory professional body(ies) such as CMD;
p. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificates, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn affidavit are compulsory for each JV Partner);
Note: All documents for submission must be submitted with a Covering/Forwarding letter under the Company’s letter head paper bearing amongst others, the Registration Number (RC) as issued by the CAC, Contact Address, Telephone Number (preferably GSM No) fax and email address. The letter head paper must bear the Names and Nationalities of the Directors of the company at the bottom of the page, duly signed by the authorized officer of the firm.
4. COLLECTION OF TENDER DOCUMENTS (INVITATION TO TENDER)
Interested companies (for Goods & works) are to collect the Standard Bidding Document (SBD) from the office of the Head of Procurement, first floor, Border Communities Development Agency, Plot 238, No. 4 Augustus Aikhomu Street, Utako district, adjacent Chida Hotel, Abuja on evidence of Payment of a non-refundable fee of N10, 000.00 per Lot (Ten Thousand Naira Only), paid into the Border Communities Development Agency’s GIFMIS CODE as stated below.

Note that:
i. Interested bidders for Consultancy Services are not expected to pay at this stage until after short-listing.
ii. Lot A409 is for expression of interest.

5. SUBMISSION OF EOI AND PREQUALIFICATION DOCUMENTS
Interested firms are to submit two (2) bound of Expression of Interest (EOI) or pre-qualification documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed as indicated in Paragraph 5 below; and clearly marked with (the name of the project and the Lot number). Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at the Reception of the Agency’s Headquarters not later than 12:00 noon, Monday, 13th May, 2024.
6. SUBMISSION OF TENDER DOCUMENTS (INVITATION TO TENDERS)
Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies each of the Technical and Financial bids with softcopy of financial bids only in MS Excel format, packaged separately (In USB Flash Drive) in sealed envelopes and clearly marked as “Technical Bid” or “Financial bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to: THE EXECUTIVE SECRETARY, BORDER COMMUNITIES DEVELOPMENT AGENCY, PLOT 238, NO. 4 AUGUSTUS AIKHOMU STREET, UTAKO DISTRICT, ADJACENT CHIDA HOTEL, ABUJA; and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at the Reception of the Agency’s Headquarters not later than 12:00 noon, Monday, 27th May, 2024
Every bidder should ensure a tender submission form receipt is issued accordingly.
7. OPENING OF EOIS/PREQUALIFICATION DOCUMENTS AND TECHNICAL BIDS
The EO/Prequalification documents and the technical bids will be opened immediately after the deadline for submission at 12:00 noon, Monday, 27th May, 2024 and 12:00 noon Monday, 27th May, 2024, respectively in the Conference Room of the Agency in the presence of bidders or their representatives, while the financial bids will be kept un-opened.
Please ensure that you sign the Bid Submission Register in the Office of the Head Procurement, Border Communities Development Agency, Plot 238, No. 4 Augustus Aikhomu Street, Utako district, adjacent Chida Hotel, Abuja as the Agency will not be held liable for misplaced or wrongly submitted bids. 8. GENERAL INFORMATION
a. Bids must be in English Language and signed by an official authorized by the bidder.
b. Bids submitted after the deadline for submission would be returned un- opened.
c. Bidders should not bid for more than two (2) Lots (violators will be automatically disqualified).
d. All costs will be borne by the bidders.
e. The EOI/technical bids will be opened in the presence of bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and private professional bodies; and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online;
f. Invitation to tender: Only prequalified bidders at technical evaluation will be invited at a later date for virtual financial bids opening, while the financial bids of unsuccessful bidders will be returned un-opened.
g. Invitation to Pre-qualification: Only prequalified bidders at technical evaluation will be invited at a later date for collection of Tender documents;
h. Consultancy Services: Only shortlisted firms will be invited at a later date for collection of Request for Proposals.
i. BCDA is not bound to pre-qualify/shortlist any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.

Please note: Lot A279 (provision of relief materials, Abba-Na Shehu Ward, Jos North, Jos LGA, Plateau state) under the BCDA 2024 capital projects that was advertised on Monday, 15th April, 2024 in the Federal Tenders Journal, the Authority and This Nigeria Newspaper was erroneously included in the advertisement.
The attention of the Public is hereby drawn to the error and all suppliers and service providers that intend to apply for lot are advised to kindly note.
