INVITATION FOR PREQUALIFICATION/EXPRESSION OF INTEREST/TENDER FOR TECHNICAL AND FINANCIAL BIDS FOR PROCUREMENT OF GOODS, WORKS AND SERVICES UNDER THE MINISTRY’S FY2024 APPROPRIATION

1. INTRODUCTION
The Federal Government of Nigeria has provided funds in 2024 appropriation act for the Federal Ministry of Sports Development (FMSD). The Ministry is a machinery of government with the mandate of using sports as a strategic tool for national unity, job creation, and enabler of significant revenue generation and GDP growth. The Ministry’s mission is to be the vehicle that brings life and liveliness into Nigerian Sports so as to bring the joy of sports to families and become a source of national cohesion.

The Ministry, in pursuance of the Federal Government’s Sports Development Roadmap and towards achieving its policies and mandatory objectives, wishes to implement its 2024 capital projects through procurement of various works, Goods and Consultancy services in compliance with the Public Procurement Act (PPA 2007.

In pursuance of the above, experience and reputable suppliers, contractors and contractors and consultants/service providers/vendors are hereby invited to express interest and submit tender for the under listed projects.

2. SCOPE OF GOODS/WORKS/SERVICES
CATEGORY A: CONSTITUENCY PROJECTS – GOODS
Interested contractors are invited to submit for tender documents

3. ELIGIBILITY REQUIREMENTS
The general public may wish to be guided that all procurement activities of the Ministry shall be fully governed by the Public Procurement Act (PPA) 2007 and the recent Federal Government Executive order on Transparency and support for local content in public procurement whereby prospective bidders should submit the following minimum eligibility criteria;
Company signed forwarding letter stating the corporate affairs registration number at the top and names of all Directors at the bottom clearly specifying area of competence and interested category and lot.
a. Evidence of Certificate of incorporation with Corporate Affairs Commission (CAC) including forms CA22 and CAC7. Business name with form BN1s is also acceptable for consultancy services;
b. Evidence of Tax Clearance Certificate(or personal Income Tax Clearance Certificates for all partners) for the last three (3) years expiring 31st December 31st, 2024; with minimum average annual turnovers of N50 million for works and N20 million for goods;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above).
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December, 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn affidavit
• disclosing whether or not any officer of the relevant committees of the Federal Ministry of Sports Development or Bureau of Public Procurement (BPP) is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• That no director has been convicted in any county for any criminal offence relating to fraud impropriety or criminal misrepresentation of falsification of facts relating to any matter.
• That the company is not in receivership, the subject of any form or bankruptcy proceedings of the subject of any form of winding up petition or proceeding
h. Company’s Audited Accounts for the last three years (2021, 2022 & 2023)
i. Reference letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s profile with the curriculum Vitae of key staff to be deployed for the project, including copies of their academic/professional qualifications such as COREN, QSDRBN, ARCON, CORBON etc;
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
l. List of plants/equipment with proof of ownership/lease agreement;
m. For Supply of equipment: Letter of Authorization as representative of the Original Equipment Manufacturers (OEMs)
n. Consultancy services: evidence of firms current registration with the relevant regulatory professional body(ies) such as COREN, QSRBN, ARCON, CORBON ETC
o. Firms submitting as Joint Venture (JVs) should include Memorandum of Understanding (MOU) indicating the responsibility and duties of the individual firms constituting the JV as well as Names and Skills of Key Staff under each Company in the JV such that an informed judgment on the Firm’s Capacity in terms of Permanent or Borrowed Personnel can be determined

4. GUIDELINE FOR COLLECTION AND SUBMISSION OF TENDER DOCUMENTS
a. All submissions must be in English language
b. Interested bidders for categories A and B3 (goods and works) shall obtain tender documents from procurement department, Federal Ministry of Sports Development, Abuja.
c. The completed expression of interest (EOI) & prequalification for category ‘B1 & B2” are to be submitted in two (2) hard copies in a sealed tamper proof envelope, with the appropriate project title and lot no at the top right hand corner, and addressed to;
The Permanent Secretary,
Federal Ministry of Sports Development (FMSD),
Pakage A, Moshood Abiola National Stadium Abuja.
The closing date for submission of EOI & Prequalification is on or before 12:00 noon, Monday 27th May, 2024.
d. The completed Technical and Financial bids for Categories A & B3 (2 hard copies and 1 soft copy) shall be submitted in two different sealed tamper proof envelopes and labeled “Technical Bid” and “Financial Bid” and both placed in a third envelope. All the three (3) envelopes should bear the Company’s name at the reverse side while the “Project Name” and Lot No. at the Top Right-Hand corner of the envelope and addressed as in paragraph C above and submitted in the same location, not later than 12:00 noon Monday 10th June 2024.

5. OPENING OF TECHNICAL BIDS
The Technical bids for lots A and B3 will be opened on Monday 10th June, 2024, at the Media Centre, Moshood Abiola National Stadium Abuja, immediately after the close of bidding, at 12:00pm in the presence of Bidders or their Representatives and Statutory observers, while the financial bids will be kept un-opened.
The Expression of Interest documents will be opened at Media Centre, Moshood Abiola National Stadium Abuja, immediately after the close of bidding, at 12:00 noon on Monday 27 May, 2024.

6. NOTE
a. The Ministry shall verify any or all the claims made by bidders and shall disqualify any company whose claims are found to be false, in addition to other sanctions that may be deemed necessary.
b. Bidders who have worked for the Ministry and have History of poor performance, abandonment or prolonged contract execution period need not apply;
c. All costs incurred in responding to this advert shall be borne solely by the Bidders:
d. All Bidders should not bid for more than 2 Lots;
e. All submission pages must be duly initialed by an authorized staff of the Company;
f. Non-Compliance to the instructions will lead to disqualification.
g. Bid document(s) submitted late shall be returned un-opened;
h. The advertisement shall not be construed to be a commitment on the part of the Federal Ministry of Sports Development nor shall it entitle the applicant to make any claim(s) whatsoever and/or seek any indemnity from Federal Ministry of Sports Development by virtue of such applicant having responded to this advertisement.
i. The EOIs/Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies, and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online,
j. Category A & B3: Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned un-opened;
k. Category B1 & B2: Only pre-qualified bidders will be invited at a later date for collection of tender documents;
l. Category C: Only shortlisted Applicants at EOI’s evaluation will be invited at a later date for collection of Request for Proposals,
m. The Federal Ministry of Sports Development is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007;
