INVITATION TO TENDER FOR 2024 CAPITAL PROJECTS

1. INTRODUCTION
Federal University of Agriculture, Bassambiri (FUAB), Bayelsa State, was established in April, 2023 and the Federal Government has appropriated fund under the 2024 Fiscal Year for the procurement of goods, works and services. In compliance with the Public Procurement Act of 2007, the University hereby invites tenders from competent and experienced Suppliers, Contractors and Consultants for the following Projects:

2. SCOPE OF PROCUREMENT
LOT 1 – PROCUREMENT OF ONE (1) UNIT OF 2024 SALON CAR FOR THE UNIVERSITY.
LOT 2 – PROCUREMENT OF OFFICE FURNITURE AND FITTINGS FOR THE UNIVERSITY.
LOT 3 – PROCUREMENT, INSTALLATION, TESTING AND COMMISSIONING OF POWER GENERATING SET FOR THE UNIVERSITY
LOT 4 – CONSTRUCTION/PROVISION OF OFFICE BUILDING
LOT 5 – CONSTRUCTION/PROVISION OF WATER FACILITIES
LOT 6 – CONSTRUCTION/PROVISION OF HOSPITAL/HEALTH CENTRE
LOT 7 – COSTRUCTION/PROVISION OF LIBRARY
LOT 8 – CONSTRUCTION/PROVISION OF ROAD
LOT 9 – REPAIRS OF OFFICE BUILDINGS
LOT 10 – INDUSTRIAL POLLUTION/ PREVENTION AND CONTROL FOR THE UNIVERSITY.

3. ELIGIBILITY REQUIREMENTS
Prospective bidders should submit the following:
a. Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including Form CAC 1.1 or CAC 2 and CAC 7 or Status Report.
b. Evidence of Company’s Income Tax Clearance Certificate for the last three (3) years 2022, 2023 & 2024 valid till 31st December, 2025 with a minimum average annual turnover of ₦5 million only.
c. Evidence of Pension Clearance Certificate valid till 31st December, 2025 (these requirements are only applicable to bidders whose number of staff is 5 and above).
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2025 (these requirements are only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is ₦50 million and above).
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2025.
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2025 or valid Certificate issued by Bureau of Public Procurement (BPP).
g. Evidence of Ownership or Memorandum of Understanding for the Lease of Plants, Machineries and Equipment for Operations (applicable to LOT 4-8).
h. Sworn Affidavit from High Court or Court of Coordinate Jurisdiction.
i. Disclosing whether or not any officer of the relevant Committees of the Federal University of Agriculture, Bassambiri, Bayelsa State or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars.
ii. That no Director of the company has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter.
iii. That the Company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceedings.
iv. That the Company does not have existing loan or financial liability with a bank, other financial institutions or third party that is classified as doubtful, non-performance, bad or whose repayment portion has been outstanding for the last four (4) months.
i. Company Audited Accounts for the last three years 2022, 2023 and 2024 duly acknowledged by Federal Inland Revenue Service (FIRS).
j. Reference Letter from a reputable Commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the projects, if the need arises.
k. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided indicating among others the Lead Partner (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR and Sworn Affidavit are compulsory for each Joint Venture Partner).
l. Evidence in the CAC documents indicating that the bidder is a registered and practicing Procurement or Construction Company respectively.
m. Evidence of Original Equipment Manufacturer’s (OEM) Certificate from Manufacturers or Letter of Authorization from Representative(s) in Nigeria (applicable to LOT 1 only). Please, note that only companies included and accredited by the National Automobile Development and Design Council (NADDC) and recognized by the Bureau of Public Procurement (BPP) will be accepted.
n. All documents for submission must be transmitted with a Covering/Forwarding Letter under the Company/Firm’s Letter head Paper bearing amongst others; the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM NO.), and E-mail Address. The Letter head Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.
o. All documents for submission must be arranged in the chronological order as in 3 (a – m) above or automatic disqualification.

4. COLLECTION OF TENDER DOCUMENTS
Interested companies are to collect the Bidding Document from the Office of Ag. Head of Procurement, Procurement Unit, Federal University of Agriculture, Bassambiri, Bayelsa State on evidence of payment of a non-refundable tender fee of ₦10,000 per LOT, paid into the University’s (FEDERAL UNIVERSITY OF AGRICULTURE, BASSAMBIRI, BAYELSA STATE) Remita Account in any reputable Commercial Bank in Nigeria.

5. SUBMISSION OF DOCUMENTS
Prospective bidders are to submit bid for not more than two (2) LOTS, one (1) hard copy each of the technical and financial bids with soft copy of financial bid only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “Technical Bid” or “Financial Bid”. Thereafter, put the two (2) sealed envelopes together in a bigger sealed envelope addressed to the Vice-Chancellor, Federal University of Agriculture, Bassambiri, P. M. B. 180, Yenagoa, Bayelsa State at the Administrative Building of the University and clearly marked with the name of the Project and the LOT Number at the top left hand corner and drop it in the tamper-proof box. Furthermore, the reverse of each sealed envelope should bear the name, address and telephone number of the bidder and drop in the designated Tender Box at the Administrative Building, Federal University of Agriculture, Bassambiri, Bayelsa State not later than 12 noon, Monday, September 29, 2025.

6. OPENING OF TECHNICAL BIDS
The submitted technical bids will be opened immediately after the deadline for submission 12 noon, Monday, September 29, 2025, at the Administrative Building, Federal University of Agriculture, Bassambiri, Bayelsa State.
Please, ensure that you sign the Bid Submission Register at the point of submission as Federal University of Agriculture, Bassambiri, Bayelsa State will not be held liable for misplaced or wrongly submitted bids. 7. GENERAL INFORMATION
a. Bids must be in English Language and signed by an official authorized by the bidder.
b. Bids submitted after the deadline for submission shall be rejected and returned un-opened to the bidder.
c. Bidders should not bid for more than two (2) LOTS, contravention is automatic disqualification.
d. All costs incurred as a result of this tender invitation and subsequent requests for information shall be borne by the bidders.
e. Delivery of bids through Courier Services will not be accepted, if received after the deadline.
f. The bids will be opened immediately after the deadline in the presence of Civil Society Organizations (CSOs), Non-governmental Organizations (NGOs) and Professional Bodies.
g. Only pre-qualified bidders at the technical evaluation will be invited at a later date for financial bids opening, while the financial bids of unsuccessful bidders will be returned unopened.

Federal University of Agriculture, Bassambiri, Bayelsa State is not bound to pre-qualify any bidder and reserves the right to annul the Procurement Process at anytime without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
