INVITATION TO TENDER AND EXPRESSION OF INTEREST FOR PROJECTS UNDER THE NATIONAL COUNCIL FOR ARTS AND CULTURE’S FY2025 CAPITAL EXPENDITURE
1.0 INTRODUCTION
1.1 The National Council for Arts and Culture, Abuja is desirous of carrying out the underlisted programmes and projects as contained in its 2025 appropriation.
1.2 Accordingly, the Council invites qualified, interested and eligible contractors/suppliers to participate in the tendering process for procurement of Goods, Works and Services projects under the Council’s 2025 Appropriation as specified in the summary tables below and detailed in the solicitation Standard Bidding Documents to be collected from the Council:

3.0 ELIGIBILITY REQUIREMENTS
a. Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including the Memorandum and Article of Association, Certificate of Incorporation for Business Name is also acceptable for Services;
b. Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all the Partners in case of Business Name) for the last three (3) years (2023, 2024 and 2025) valid till 31st December, 2025;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2025 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2025 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2025;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2025 or valid Certificate issued by BPP.
g. Unabridged Company Audited Accounts for the last three (3) years (2022, 2023 & 2024);
h. Sworn Affidavit:
– disclosing whether or not any officer of the relevant committees of the National Council for Arts and Culture or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
– that no Director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter;
i. Evidence of financial capability to execute the project by submission of Reference Letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications (in case of construction: COREN, QSRBN, ARCON, CORBON, etc.).
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects.
l. For Services: Evidence of Firm’s current registration with the Centre Management Development (CMD);
m. For construction: List of Plants and Equipment with proof of Ownership/Lease;
n. For ICT jobs: Evidence of registration with National Information Technology Development Agency (NITDA) and Computer Professionals Registration Council of Nigeria;
o. For Joint Venture/Partnership, Memorandum of Understanding (MoU) duly registered in High Court should be provided (CAC, Tax Clearance Certificate, Pension Compliance Certificate, NSITF Compliance Certificate, ITF Compliance Certificate, BPP IRR & Sworn Affidavit are compulsory for each JV partner);
p. All documents for submission must be transmitted to the Council with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM Number), and e-mail address. The letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.
4.0 COLLECTION OF TENDER DOCUMENTS (CATEGORY A, B & C)
Interested companies/bidders are to collect the Standard Bidding Document (SBD) from the 2nd Floor, Procurement Unit, Nigerian Culture House, National Council for Arts and Culture (NCAC), Gudu District, Abuja, FCT, between 10am and 4pm upon presentation of evidence of payment of a non-refundable tender fee of N10,000.00 (Ten Thousand Naira only) per Lot. This is payable by all bidders into the paid into the Federal Government Single Treasury Account (TSA) [National Council for Arts and Culture’s] Remita account in any commercial bank with the following account details:-

5.0 SUBMISSION OF TENDER/EOI DOCUMENTS
5.1 SUBMISSION OF TENDER DOCUMENTS FOR CATEGORY A & B
Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies (one original and one other copy) each of the completed technical and financial bids with softcopy of financial bid only (saved in a Flash Drive) in MS Excel format, packaged separately in sealed envelopes and clearly marked “Technical Bid” or “Financial Bid”. The soft copies must not be scanned copies. Thereafter, put the two sealed envelopes together in a bigger sealed envelope, with the Project Name and Lot number clearly written on the top right-hand corner, addressed and returned to:

Furthermore, the reverse of each scaled envelope should have the name and address of the bidder and dropped in the designated Tender Box at the office of Head, Procurement Unit, 2nd Floor, NCAC Headquarters, Nigerian Culture House, Gudu District, Abuja between 9:00am and 4:00pm daily not later than 12:00 noon on Monday, 9th June, 2025.
5.2 SUBMISSION OF EOI DOCUMENTS FOR CATEGORY C
Prospective bidders are to submit EOI documents for each of the Lot desired; two (2) hard-copies each of the technical bids/EOI packaged in sealed envelopes and clearly marked as “Technical Bid” or “EOI”; and addressed as stated above and clearly marked with (the name of the project and the Lot number). Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and drop in the designated Tender Box at the Tender Secretariat, Procurement Unit, 2nd Floor, NCAC Headquarters, Nigerian Culture House, Gudu District, Abuja not later than 12:00 noon on Monday, 26th May, 2025. Companies or their representatives, Civil Societies, NGOs, Professional Bodies and members of the public are invited to witness the bids opening exercise.
6.0 OPENING OF BIDS/EOIs
6.1 Technical Bids and EOI will be opened immediately after the deadlines for submission by 12:00 noon on Monday 26th May, 2025 for Category C; and by 12:00 noon on Monday 9th June, 2025 for Category A & B respectively at Tender Secretariat, Procurement Unit, 2nd Floor, NCAC Headquarters, Nigerian Culture House, Gudu District, Abuja, in the presence of bidders or their representatives, while the Financial bids will be kept un-opened.

7.0 PLEASE NOTE THAT:
a. Bids must be in English Language and signed by an official authorized by the bidder.
b. Bids submitted after the deadline for submission would be returned un-opened.
c. Bidders should not bid for more than two (2) Lots (note: this maximum ceiling is important in order not to over-stretch bidder’s capacity, and causing delay in project delivery).
d. All costs incurred in responding to this advert shall be borne solely by the Bidders.
e. All pre-qualified bidders will be contacted at a later date for financial bid opening, while bids of un-successful bidders will be returned un-opened.
f. Two (2) hard copies and one (1) soft copy each for Technical and Financial bids are to be submitted for each lot applied for; soft copy for Financial Bid MUST Strictly be in Excel Format as issued in the Bid document.
g. All Bidding Documents submitted will be subjected to Due Diligence (registration with CAC, tax clearance certificates, etc.) checks in accordance with the Public Procurement Act (PPA) 2007.
h. The National Council for Arts and Culture (NCAC) is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
i. Non-compliance to the instructions in this advert and late submission of bid will lead to outright disqualification.
j. Submission of technical/financial bids to the Council is neither a commitment nor an obligation to award any contract to any contractor or service provider.
k. This advertisement shall not be construed to be a commitment on the part of the Council to award contract to any bidder nor shall it entitle the bidding companies to any claim whatsoever and/or seek indemnity from the Council by virtue of such company having responded to the advertisement.
l. The final conclusion of the Procurement Process for all Projects listed above is subject to Budgetary Releases from the Treasury under the FY2025 Appropriation.
All Technical Bid documents MUST be accompanied with duly signed submission letters by the Bidders. Any unsigned document will be disqualified.
m. The Council may verify any or all the claims made by applicants and shall disqualify any company whose claims are found to be false in addition to other sanctions that may be deemed necessary.
n. Any form of canvassing from any source whatsoever shall attract immediate disqualification.
