INVITATION FOR PRE-QUALIFICATION, TENDER AND EXPRESSION OF INTEREST FOR IMPLEMENTATION OF 2024/2025 CAPITAL BUDGET

1. INTRODUCTION
The National Hydroelectric Power Producing Areas Development Commission (N-HYPPADEC) is a federal government agency that was passed into law in the year 2010 (ACT, 2020, NO 87 of 2010), charged with the responsibility of managing the ecological menace to the operation of dams; and for related matters.

2. SCOPE OF WORKS/GOODS/SERVICES
The commission, in order to effectively deliver on its mandate, hereby invites interested, competent and reputable service providers/contractors/ suppliers with relevant experience and requisite expertise for prequalification, expression of interest and tender to apply for the following works, supplies and consultancy services for implementation in the current year.

CATEGORY A: WORKS
A1: Construction of N-HYPPADEC headquarters office permanent site in Minna, Niger state.

CATEGORY B: GOODS
B1: supply of office stationaries and consumables
B2: supply of ICT equipment
B3: purchase of official operational vehicles

CATEGORY C: SERVICES
C1: staff capacity building to N-HYPPADEC staff
C2: archiving of procurement records of procurement unit
C3: engagement of consultant for N-HYPPADEC HQ building
C4: engagement of media houses
C5: engagement of solicitors
C6: legal library in states offices to N-HYPPADEC states in Benue, Kebbi, Plateau, Niger, Kwara, Kogi, Nasarawa, Kaduna, Taraba and Gombe states

3. ELIGIBILITY REQUIREMENTS
The following documents should be submitted:
a. Evidence of certificate of Incorporation with the Corporate Affairs Commission (CAC) including form CAC1.1 and CAC2 and CAC7. Business name is also acceptable for services:
b. Evidence of Company’s Income Tax Clearance Certificate (or personal income tax clearance certificates of all the partners in case of business name ) for the Last three (3) years valid till 31st December, 2024; with minimum average annual turnover of N25million;
c. Evidence of pension Clearance Certificate valid till 31st December, 2024 (this requirements is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate Valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is ₦50Million and above);
e. Evidence of Nigerian social Insurance Trust Fund (NSITF) Clearance Certificate Valid till 31st December 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn Affidavit:
 Disclosing whether or not any officer of the relevant committees of the Ahmadu bello university, Zaria or the Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
 That no Director has been convicted in any country for any criminal offence relating to fraud of financial impropriety or criminal misinterpretation or falsification of facts relating to any matter;
 That the company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petitions or proceedings;

h. Company’s Audited Accounts for the last three (3) years (2021,2022 and 2023);
i. Reference letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s profile with the Curriculum Vitae of key Staff to be deployed for the project, including copies of their Academic/ Professional qualifications COREN, QSRBN, ARCON, CORBON, etc.;
k. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
l. Works: List of Plants/Equipment with proof of Ownership/Lease Agreement;
m. Consultancy services: evidence of the firm’s current registration with relevant regulatory professional body(ies) such as COREN, QSRBN, ARCON, CORBON, CMD, SURCON, MDCN, NITDA, etc.;
n. Only companies included in the national automotive design and development council’s approved list of local manufacturers of vehicles or their authorized representatives should bid for the vehicles;
o. Supply of equipment: letter of authorization as representative of the original equipment manufacturers (OEMS);
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM NO.) and e-mail address. The Letter head Paper must bear the names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

4. COLLECTION OF TENDER DOCUMENTS (GOODS & WORKS)
Interested companies are to collect the standard Bidding Document (SBD) from the procurement unit office, national hydroelectric power producing areas development commission, Abdulsalami Abubarkar way, minna, Niger state, on evidence of payments of non-refundable Tender Fee of N10, 000.00 per Lot, paid into the national hydroelectric power producing areas development commission, in any reputable Commercial Bank in Nigeria.
Note that interested bidders for consultancy services and pre-qualification are not expected to pay at this stage. Items no A1, B3 are for pre-qualification.

5. COLLECTION OF TENDER DOCUMENTS (GOOD & WORKS)
Interested firms are to submit two (2) bound of expression of interest (EOI) and pre-qualification documents as applicable, separated by dividers and arranged as indicated above. The Documents should be submitted in a sealed envelope and addressed as indicated above, and clearly marked with (the name of the project and the lot number). Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop it in the designated tender box at the reception of the commission headquarters not later than 12:00 noon on Wednesday, 4th September, 2024.

6. SUBMISSION OF TENDER DOCUMENTS (GOODS & WORKS-INVITATION TO TENDERS)
All prospective bidders are to submit bids for each of the lot desired two (2) hard copies of each of the technical and financial bids, packaged separately in sealed envelope and clearly marked as “Technical bid” or “Financial Bid’. Thereafter, put the two sealed envelopes addressed o the managing director, national hydroelectric power producing areas development commission, Abdulsalmai Abubarkar way, Minna, Niger state; and clearly marked with the name of the project and the lot number. Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and drop it in designated tender box at the reception of the commission headquarters no later than 12:00 noon Wednesday, 25th September, 2024.

7. BID OPENING
SERVICES AND PRE-QUALIFICATION
The EOI and pre-qualification documents will be opened immediately after the deadline for submission at 12:00 noon on Wednesday, 4th September, 2024 at the commission’s headquarters in Minna.
GOODS & WORKS (invitation to tenders)
Only the technical bids will be opened immediately after the deadline for submission at 12:00noon of Wednesday, 25th September, 2024, at the commission’s headquarters in Minna.

8. GENERAL INFORMATION
a. EOIs/Bids must be in English Language and signed by an official authorized by the bidder;
b. EOIs/Bids submitted after the deadline for submission would be returned un-opened;
c. Bidders should no bid for more than two (2) lots;
d. All costs incurred in responding to this advertisement shall be borne solely by the bidders.
e. EOIs/Bids will be opened in the presence of CSOs and professional bodies and covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online;
f. This advertisement shall not be construed as a commitment on the part of the commission to award a contract to any bidder;
g. Invitation to tenders: only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned un-opened upon request.
h. Invitation to pre-qualification: only pre-qualified bidders will be invited at a later date for collection of tender documents;
i. Request for EOI: only shortlisted applicants will be invited at a later date for the collection of request for proposals;
j. The commission is not bound to pre-qualify any bidder and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with Section 28 of the Procurement Act, 2007.
