EXPRESSION OF INTEREST FOR THE EXECUTION OF PROJECTS UNDER THE NIGERIAN COMMUNICATIONS COMMISSION (NCC) 2024 BUDGET

1. INTRODUCTION
The Nigerian Communications Commission (NCC) is the regulatory authority for the telecommunications industry in Nigeria. Pursuant to its statutory mandate and in compliance with the provisions of the Public Procurement Act 2007, the NCC under its 2024 budget hereby invites qualified, competent, and reputable contractors, consultants, and service providers to submit expression of interest (EOI) for the following services:

2. ELIGIBILITY REQUIREMENTS:
All tenders must comply with the requirements of public procurement act, 2007 and interested bidders must submit the following documents:
a. Evidence of certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including forms CAC1.1 or CAC2 and CAC7; business name is also acceptable for consultancy services;
b. CTC of articles and memorandum of association of the company. It must show that the company has ICT related activities as part of its objectives (ICT objectives not a requirement for non-ICT projects and goods)
c. Evidence of Company’s Income Tax Clearance Certificate for the Last three (3) years valid till 31st December, 2024;
d. Evidence of pension Clearance Certificate for the Last three (3) years (this requirement is only applicable to bidders whose number of staffs is 15 and above);
e. Evidence of Industrial Training Fund (ITF) Compliance Certificate Valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is ₦50Million and above);
f. Evidence of Nigerian social Insurance Trust Fund (NSITF) Clearance Certificate Valid till 31st December 2024;
g. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
h. Sworn Affidavit:
 Disclosing whether or not any officer of the relevant committees of the Nigerian Communication Commission or the Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
 That no Director has been convicted in any country for any criminal offence relating to fraud of financial impropriety or criminal misinterpretation or falsification of facts relating to any matter;
 That the company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petitions or proceedings;

i. Company’s Audited Accounts for the last three (3) years -2021,2022,2023;
j. Reference letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
k. Company’s profile with the Curriculum Vitae of key Staff to be deployed for the project, including copies of Academic/Professional qualification such as COREN, QSRBN, ARCON, CORBON, CPN, EHORECON, ETC.;
l. ICT JOBS: Evidence of company’s current registration with relevant regulatory professional body (ies) such as NITDA/CPN/information communication technology.
m. Lot CORP 39b: operational license issued by NAICOM, valid and adequate re-insurance treaty arrangement & certified true copy of audited accounts approved by NAICOM. Company must also have experience in aviation insurance
n. Verifiable documentary evidence of at least three (3) similar projects carried out in the past five (5) years accompanied by letters of award, valuation/job completion certificates and photographs of the projects.
o. Possession of appropriate NCC license for all telecommunications specific projects.
p. For joint Venture/ Partnership, the following documents must be provided for each JV partner: memorandum of understanding (MoU), CAC, tax clearance certificate, pension compliance certificate, ITF compliance certificate, NSITF clearance certificate, IRR & affidavit.

NOTE: NOT MORE THAN TWO COMPANIES SHOULD FORM A JOINT VENTURE

Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM NO.) and e-mail address. The Letter head Paper must bear the names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

3. SUBMISSION OF EOI DOCUMENTS
Interested firms are to submit two (2) bound of expression of interest (EOI) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed to the head, procurement department, 2nd floor, room 219, Nigerian communications commission head office, plot 423 aguiyi Ironsi Street, maitama, Abuja and clearly marked with the name of the project and the lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated tender box at the procurement department, 2nd floor, room 219, Nigerian communications commission head office, plot 423 aguiyi ironsi street, maitama, Abuja not later than 10:00am on Monday, 5th August, 2024.

4. OPENING OF EOI DOCUMENTS
the EOI will be opened immediately after the deadline for submission at 10:00am on monday, 5th August, 2024, at the Nigerian communications commission head office, plot 423 aguiyi ironsi street, maitama, Abuja in the presence of bidders or their representatives. Please, ensure that you sign the Bid Submission Register in the procurement department, 2nd floor, room 219, Nigerian communications commission head office, plot 423 aguiyi ironsi street, maitama, Abuja, as the Nigerian communications commission will not be held Liable for misplaced or wrongly submitted bids. 5. GENERAL INFORMATION
a. EOI must be in English Language and signed by an official authorized by the bidder;
b. EOI submitted after the deadline for submission would be returned un-opened;
c. Applicants should not bid for more than two (2) lots OF ALL 2024 ncc PROJECTS AND CONSULTANCIES.
d. All costs will be borne by the bidders;
e. NCC will assume no responsibility for the content of tamper evident bids or for non-compliance with this instruction. Bids that do not comply with this instruction may be returned;
f. Kindly note that submissions may be subjected to verification from relevant authorities. Fake documents and false declaration may be forwarded to the relevant authorities for prosecution.
g. Bidders can submit through post (courier services), however, all EOIs must be received on or before the deadline for submission;
h. The EOI will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies; and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online;
i. This advertisement is published for information purposes and should not be construed as a commitment or obligation on the part of the NCC to award contract;
j. Only shortlisted firm’s will be invited at a later date for collection of request for proposals;
k. The Nigerian communications commission is not bound to pre-qualify any bidder and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with Section 28 of the Procurement Act, 2007.
