TENDER OPPORTUNITY: PROCUREMENT OF LINE PIPES FOR SEPLAT OPERATIONS
1. INTRODUCTION
In line with NEPL/SEPLAT JV’s short and long term business plans, several flow lines and bulk lines are required to be construed within Seplat Western Asset (OML- 4, 38 and 410. In view of this, line pipe will be required to achieve the seamless construction and commissioning of these networks of pipelines. Therefore, the proposed contract is for the procurement of seplat/NEPL/JV Line pipes, including inductive bends.
Qualified contractors shall need to demonstrate capability and capacity in dealing with the financial and technical requirements involved in the procurement, coating delivery of seamless line pipes used for the construction of pipelines and process piping systems in the oil and gas industry.
The proposed strategy will utilize the Nipex Contracting platform to run the tendering process

BRIEF DESCRIPTION OF THE ITEM (INCLUDING BUT NOT LIMITED TO THE UNDERSTATED)
Procurement of line pipes scope:
i. Procurement of coated seamless line pipes as specified
ii. Procurement of coated seamless inductive bends as specified
iii. Bevellard ends
iv. 3-layer Polyethylene (3LPE) coating
v. Factory acceptance test/Inspection
vi. Shipping/transportation of line pipes.
vii. Delivery of line pipes to Seplat warehouse of Okayed, along Sapele/Warri road, Sapele
viii. Complete technical documentations of all line pipes
ix. Complete shipping documentation of all line pipes
SPECIAL CONSIDERATION
The selected vendors must have proven experience in the procurement and delivery of 3LPE coated, seamless line pipes. The experience can be demonstrated by providing documents of successful delivery of similar procurement services in alliance with line pipe manufacturing OEM’s that have milling and coating plants. The vendors must provide a Memorandum of Understanding (MOU) with the line pipes original Equipment Manufacturer (OEM). The vendors must also demonstrate financial capability and capacity to execute the contract without depending on advance payment.
3. MANDATORY TENDER REQUIREMENT
1. To be eligible for this tender exercise, interested bidders are required to be pre-qualified and ‘live’ in the relevant product/services categories of NipeX Joint Qualification System (NJQS) database. All successfully pre-qualified and ‘live’ bidders in this category by the bid close date will receive Invitation to Tender (ITT).
2. To determine if you are pre-qualified and view the product/service category you are listed for: Visit http://vendors.nipex-ng.com and access NJQS with your login details. Click on products/services status tab to view your status and product codes.
3. If you are not listed in a product/service category and you are registered with Nigerian Upstream Petroleum Regulatory Commission (NUPRC) to do business, contact NipeX office at 8, Bayo Kuku Street, Ikoyi, Lagos with your NUPRC certificate as evidence for verification and necessary update.
4. To initiate the JQS pre-qualification process, access www.nipex-ng.com, click on services tab followed by NJQS registration.
5. Any entity intending to bid as a joint venture/alliance must demonstrate a genuine alliance or joint venture with details on scope and responsibilities of parties for this work, and payment arrangements such companies must show evidence of joint venture via a legally binding agreement duly signed by the Chief Executive Officer (CEO) or both companies. In the absence of a binding legal agreement relating directly to this activity, the Company submitting the response on must son behalf of the alliance/joint venture must supply a power of attorney authorizing it to do so.
6. To be eligible, all tenders must comply with the Nigerian content requirements in the NipeX system, in this section below OGTAN shall mean Oil and gas trainers association of Nigeria and NCEC shall mean Nigerian Content Equipment Certificate.
4. NIGERIAN CONTENT REQUIREMENT
Seplat as an indigenous exploration and production (energy) company in Nigeria is committed to the development of the capabilities of Nigerian companies in compliance with the provisions of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act 2010 for Nigerian Content Development. Bidders are to note that they will be requested in the technical tender to provide details of their relevant strategy to ensure that they fully comply with the Nigerian Oil & Gas Industry Content Act, 2010 as provided at http://www.ncdmb.gov.ng/images/GUIDELINES/NCACT.pdf, since non-compliance will constitute a fatal flaw in all service evaluations. In the light of the above, tenderers shall be expected by the Nigerian Content Development Monitoring Board (NCDMB) to:
• Demonstrate that the entity proposed for execution of the service, is a Nigerian Registered company, or Nigerian Registered Company as the contracting entity in genuine alliance or joint venture with foreign company with detail on scope and responsibilities or parties for this work. Such companies must show evidence of joint venture binding agreement duly signed by the COE or both companies including evidence or plans of physical operational presence and set-up in Nigeria.
• Furnish details of company ownership and shareholdings structure (form CO2 and CO7)
• Provide evidence of what percentage of your key management positions is held by Nigerians and what percentage of the total work force are Nigerians. Also, show overall percentage of work to be performed in Nigeria and those by Nigerian resources relative to total work volume.
• Provide a Nigerian content plan with detailed description of the role, work scope, man-hours and responsibilities of all the Nigerian companies and personnel that will be involved in executing the work.
• State proposed a total scope of work to be conducted by Nigerian personnel (whether contracted directly or under subcontract agreements) with names and addresses including evidence of well-equipped offices and workshop.
• Provide evidence of domiciliation of project management and procurement centers in Nigeria with physical addresses not P.O box
• provide a detailed description of the location of in-country committed facilities & infrastructure (equipment, storage, workshops, repair, maintenance, and testing facilities)
• Provide detailed statement with evidence of how it intends to maximize the use of Nigerian made goods and services
• Provide details on any other Nigerian Content Initiative the company is involved in.
• In line with the NCD Human Capacity Development Initiative, Bidder shall commit to providing project-specific training, man-hour, budget, skill development and understudy plan for Nigerian personnel utilizing OGTAN registered trainer(s) or other approved NCDMB training institution(s).
• Provide evidence of 50% equity ownership of equipment by Nigerian subsidiary
• Provide evidence of NCEC (Nigerian Content Equipment Certificate0
• Evidence of registration on the NCDMD NOGIC JQS portal
Please note that failure to provide any of the above documentation (or requirements) will be fatal flow.
5. CLOSING DATE
Only bidders who are registered with NJQS product/Category: 2.01.01- Pipes and Tubes with a “LIVE” subscription status at 05:00hours on 25th September, 2023 being the adverts close date shall be invited to submit technical and commercial bids.
6. ADDITIONAL INFORMATION
1. All costs incurred in preparing and processing NJQS prequalification and responding to this tender opportunity shall be to the bidders
2. This “Invitation to Tender” shall neither be construed as any form of commitment on the part of NNPC/SEPLAT JV to award any contract to any bidder and or associated contractors, sub-contractors or agents, nor shall it entitle prequalified bidder to make any claims whatsoever, and/or seek any indemnity from NAPIMS/SEPLAT JV and/or any of its partners by virtue of such bidders haven been pre-qualified in NJQS.
3. SEPLAT will communicate only with authorized officers of the qualifying bidders at each stage of the tender process, as necessary, and will NOT communicate through individuals or appointed agents.
4. This tender and any related process neither creates any commitment by SEPLAT nor establish any legal relationship.
5. All information must be provided in English Language.
6. Notwithstanding the pre-qualification in NJQS, NAPIMS/SEPLAT JV is neither committed nor obliged to include your company on any bid list or to award any form of contract to that company and/or associated companies, sub-contractors, or agents.
7. NNPC/SEPLAT JV will not enter any form of communication with interested bidder(s) from the commencement date of this “Invitation to tender”.
8. Willful submission of any fictitious document will attract suspension from participation in future bids.
9. Only pre-qualified companies in the appropriate registered NipeX Categorization as at the last date of this advertisement will be eligible and shall be invited for tendering.
10. SEPLAT is not obliged to any contract to the lowest bidder or any bidder. It is at the sole discretion of NAPIMS/SEPLAT JV to decide on award of contract.
11. SEPLAT will not enter correspondence with any company or individual on why a company was shortlisted or not short-listed.
12. Evaluation of tenders and selection of successful bidders will be based on proven capability of a bidder to offer the service and submission of the lowest evaluated responsive tender.
13. Full tendering procedure will be provided only to contractors that have been successfully prequalified in NJQS.
14. Contractors that are prequalified for this product/service category in NJQS must ensure that the name and contact details (physical address, email address and telephone number) of their company and authorized/responsible personnel is up to date in their company profile in the NJQS database.
15. The tendering process shall be the NipeX contracting process requiring pre-qualified companies to submit technical and commercial tenders (double envelope tender). Following a technical review (technical evaluation), only technically and financially qualified tenderers will have their commercial tenders opened for review/evaluation.
