TENDER OPPORTUNITY: PROCUREMENT, SUPPLY, CONSTRUCTION AND COMMISSIONING PACKAGE (PSCC1) OF WELL PAD FACILITIES CONSTRUCTION & OBITE TREATMENT CENTRE TIE-IN WORKS, AND ENGINEERING, PROCUREMENT, SUPPLY, CONSTRUCTION AND COMMISSIONING PACKAGE (EPSCC20 OF 16” X 12KM MULTI-PHASE ONSHORE PIPELINE, FOR THE UBETA MAIN DEVELOPMENT PROJECT FOR TOTALENERGIES EP NIGERIA LIMITED.

1. INTRODUCTION
TotalEnergies EP Nigeria Limited (TotalEnergies), operator of the NNPCL/Total Energies Joint Venture Interested and pre-qualified Contractors with technical capacity and relevant experience to apply for these tender opportunities for the Engineering, Procurement, Supply, Construction, and Commissioning WORKS for the UBETA Main Development Project.
The WORKS will be executed at OML 58 Field, Onshore Nigeria. The expected commencement dates will be the 1st Quarter of 2024. The contracts are expected to be executed for a period of two (2) years and shall be awarded on a lump sum basis.
2. SCOPE OF WORK
The scope of work for these services shall include, but not limited to:
a. PROCUREMENT, SUPPLY, CONSTRUCTION, AND COMMISSIONING PACKAGE (PSCC1)-Well Pad Facilities Construction & OBITE TC Tie-in WORKS:
• Endorsement of Detailed Engineering performed by Other.
• Preparation and issuance of construction drawings deemed necessary for the WORKS (Fabrication & Installation). Procurement and supply of materials required for the successful completion of the scope.
• Fabrication, Construction, Pre commissioning and commissioning of a fully rated unmanned Well Pad and Production Facilities at UBETA Cluster.
• Fabrication, Construction, Tie-in, Pre-commissioning and Commissioning WORKS at the OBITE Treatment Centre (Brownfield).
ENGINEERING, PROCUREMENT, SUPPLY, CONSTRUCTION, AND COMMISSIONING PACKAGE (EPSCC3)- Pipeline Construction WORKS
• Engineering, Procurement, Supply, Fabrication, Construction, Pre-Commissioning and Commissioning of 16″x 12KM Multiphase Pipeline and Cable (Power and Fibre Optic), between UBETA Well Pad and OBITE Treatment Center.
3. MANDATORY REQUIREMENTS
a. To be eligible for either tender, interested tenderer are required to be pre-qualified and have a “LIVE” subscription status in the following respective categories of the Nipex Joint Qualification Scheme (NJCS) database by the CFT advert closing date:
i. Process Modules/Packages-4.05.09 (for PSCC1)
ii. Pipeline Systems-4.05.04 (for EPSCC2)
All successfully pre-qualified tenderers per category will receive invitations to submit their respective Tender for the services).
b. To determine if you are pre-qualified and view the product/services categories you are listed for, Open www.vendor.nipex-ng com and access same with your log in details. Click on Products/Services Status tab to view your status and product codes.
c. If you are not listed in the product/service category but you have registered with the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) to do business in the Nigerian Oil & Gas Industry, contact the NipeX administration office at 8/10 Bayo Kuku Road, Ikoyi, Lagos with your NUPRC certificate as evidence for verification and necessary update.
d. To initiate the NJQS pre-qualification process, access www.nipex-ng.com click on click on “Service” tab followed by “NJQS Registration”.
e. To be eligible, all tenders must comply with the Nigerian content requirements in the NipeX system. 1. Only Nigerian indigenous service companies having verifiable Nigerian equity shareholding of 51% and above shall submit bids for this tender.
4. PRE-QUALIFICATION REQUIREMENTS
In addition to the mandatory requirements above, only those Respondents able to demonstrate and substantiate with relevant minimum verifiable documents of proven experience (preferably within Nigeria), available resources, and readiness to undertake the WORK will be considered. The following criteria apply to the prequalification of Respondents, to be requested in due course:
TECHNICAL CAPABILITY & HSE MANAGEMENT
i. Provide a list (with values) of all major individual contracts executed directly by TENDERER initially valued at or above $50M within the last 5 years in the Nigerian Oil & Gas environment, evidenced by respective Final or Provisional Acceptance Certificates issued to Tenderer including proven similar WORK scope/product package(s).
ii. Provide evidence of Onshore Flowline Systems designed and Installed over dry/swampy Terrain in Nigeria, and in operations on previous executed project within the last, 5 years. (for PSCC1).
iii. Provide evidence of Onshore Pipeline designed and constructed over dry/swampy Terrain that is in operations on previously executed project within the last 5 years. (for EPSCC2).
iv. Provide evidence with detailed information on in-country functional fabrication yard/workshops/facilities (TENDERER owned) with the capacity to handle fabrication and loadout of Modules/Manifolds of minimum tonnage of 100 tons. Ownership of site WORKS equipment such as Mobile Cranes with a minimum capacity of 50 tons and Overhead Cranes with a minimum capacity of 5 tons.
v. Provide evidence with detailed information on in-country functional fabrication yard/workshops/ facilities (TENDERER owned) with the capacity to handle fabrication. Ownership of site WORKS equipment such as Mobile Cranes with a minimum capacity of 50 tons, Side booms within a minimum of capacity of 25 tons, and Swamp buggy are necessary, (for EPSCC2).
REGULATORY COMPLIANCE
i. Address of Registered Office in Nigeria and Name of Legal Entity.
ii. Registration Number & Category (include CAC Form CO2 & C07 and NUPRC Permit and COREN CERTIFICATES);
iii. Provide documentary evidence of a liason/partnership with a Nigerian registered company where consortium partner is not registered in NipeX;
iv. Name and address of the Ultimate Holding Tenderer (if the Respondent is a subsidiary member of a group); Respondent’s office for this WORK.
v. A valid Tax clearance for the past 3 years
FINANCIAL CAPABILITY
i. Provide Company audited financial statements for the last three (3) years. Please provide translations where accounts are published in a language other than English.
ii. Provide Financial Statements of Operating (not trading) Company and Ultimate Guarantor (eg. Parent holding companies etc.).
iii. Provide confirmation letter from all financial institution(s) that have provided short-term financing to the Respondent and details of existing third party loans or guarantees (if any).
iv. Provide evidence of Project Finance Plan for the executed WORK for the contract duration, including confirmation of financiers available line of credits, bank overdrafts and similar facilities.
v. Provide other significant financial arrangements and state the value: (a) Third party borrowings (b) inter-company loans; (c) Hire purchase agreements (d) Government grants; (e) Debt Factoring Facility and (if) any other (please specify).
vi. Provide details and potential values of any disputes currently in process with (a) any TotalEnergies JV company (b) any other operator (Oil/Gas company) and (c) any other company not mentioned in (a) and (b).
5. NIGERIAN CONTENT
TotalEnergies is committed to the development of the Nigerian Oil and gas business in compliance with the Nigerian Content Act 2010 for Nigerian Content Development.
As from the commencement of this Act, the minimum Nigerian Content in any project, service or product specification to be executed in the Nigerian all and gas industry shall be consistent with the level set in the Schedule of the Act and any other targets as may be directed by the Nigerian Content Development and Monitoring Board (The Board). Bidder(s) shall comply with all the provisions of the Nigerian Content Act that relate to this advert and in particular comply with the minimum Nigerian Content percentage for the scopes which are covered in the Schedule of the Act. This also includes and any other requirement that may arise from time to time not explicitly stated in this advert, but which apply to the services in fulfillment of the Nigerian Content Act, in the submission of their Tender
As part of their submissions, Bidder shall
a. Be Nigerian companies having greater than 51% Nigerian shareholding to bid for this work scope on land. Provide evidence of company Ownership Structure form CO2 and CO7, registration on NOGIC IOS and NUPRC certificate.
b. in line with the NCD Human Capacity Development Initiative, Bidder shall commit to providing Project-Specific training, man-hour, budget, skill development and understudy plan for Nigerian personnel utilizing OGTAN registered trainer(s) or other approved NCDMB training institution(s).
c. NCDMB approved Nigerian Content Execution Plan for authorization of the NC commitments in the scope of work or scope of supply of all call-off, work orders and purchase orders as being executed in compliance with the NOGICD Act, 2010 by the contractor or 3rd party.
d. Tenderer shall domicile 100% of project management man-hours in-country not limited to Interface management, Project control, planning, HSSE etc.
e. Tenderers shall provide evidence any of the under-listed category 1, 2, 3 or 4 NCEC to demonstrate capacity and capability to execute the work scope.
i. Fabrication and construction (FC) group
ii. Construction and moveable equipment (EC) group
f. All line pipe appurtenances including but not limited to valves, pipe fittings, flanges, including bolts and nuts, shall be procured through vendors with in-country functional manufacturing and assembly facilities having valid Manufacturing and related services (MS) group NCEC category.
g. All procurement of items not limited to LV and HV cables, paints and protective coating, sacrificial anodes, blasting abrasive grit, cable trays, gasket etc. shall be procured through vendors with in-country functional manufacturing and assembly facilities having valid NCEC for the product category.
h. All OEM and vendor related equipment shall be procured through Nigerian vendors with valid Category MS NCEC issued by NCDMB and a valid DPR permit for the product/service category.
i. Tenderer shall ensure that all fabrication is domiciled 100% in-country.
j. Tenderer shall provide evidence 1% NCDF payment (inclusive of subcontracts) for all past project in the last five years executed by the Bidders in the Nigerian oil and Gas industry.
k. Bidders are to comply with the Petroleum Industry Act (PIA).
NOTE: Failure to comply with the provision of the Nigerian Content Act 2010 or to demonstrate commitment to the development of the Nigerian Content Policy shall result in the disqualification of the bidder from the bidding process.
6. CLOSING DATE
Only Contractors, who are registered and have a “LIVE” subscription status in NJOS service categories Process Modules/Packages (4.05.09) and Pipeline Systems (4.05.04) at 1600hrs on 28 July, 2023 being the advert closing date, shall be invited to submit technical and commercial tenders.
7. ADDITIONAL INFORMATION
a. Failure to provide any of the listed documents or information, in the file format or accessible means requested, may automatically disqualify the Tenderer.
b. All costs incurred in registering and prequalifying for this and other service categories in NIQ5 shall be borne solely by the Tenderer.
c. This advertisement shall neither be construed as an invitation to Tender (ITT) nor a commitment on the part of TotalEnergies to award a contract to any supplier and/or associated companies, sub-contractors or agents.
d. The ITT and any further progression of this tender shall be via NipeX. Interested bidders are therefore advised to ensure that their profiles in NipeX (including their valid official email address) accessible by their organization as this shall be the only means to transmit the ITT.
e. Tendering process will be the NNPCL contracting process (Double Envelope Tenders (DET)) requiring pre-qualified companies to submit technical and commercial tender packages at the same time. Following a technical review, commercial tenders of technically/financially/contractually qualified contractors will be evaluated.
f. Man hour figures for Capital Project Portfolios are best estimates to provide definition to the scope and do not constitute guaranteed quantities.
g. TotalEnergies will only recognize and correspond with duly authorized officers of the pre-qualified bidders and NOT through individuals or agents acting on their behalf.
h. Interested Tenderer(s) should note that TotalEnergies has very cordial relationship with the host communities of the sites where these services may be performed based on existing Memorandum of Understanding (MOU). Prospective tenderer(s) will be required to implement the obligations of the MOU as part of their contract.
i. COMPANY reserves the right to award one or more contracts from this Call for Tender Process.
